Warranty conditions

Company EDELFIA S.R.L. (J40/3822/2023, CUI 47711190, registered office: Bucharest, Sector 2, CALEA MOŞILOR street, No. 158, ROOM 4, MODUL 165, Floor 4), which sells products (shoes, bags, belts, wallets and other accessories) under the POTAMY/COTAMY PREMIUM brand.

The selling company guarantees the products (shoes, bags, belts and wallets) sold in accordance with the provisions of the Government Emergency Ordinance 140/2021 on the goods sales and its guarantees, and Government Ordinance No. 21/1992 on consumers' protection.

Warranty conditions

The seller is liable to the consumer for any lack of conformity existing at the time when the products were delivered and quality non-conformities discovered within two years from the date of delivery.

In the event of the discovery of any defects or product quality non-conformities, consumers have the right to demand the seller to repair the delivered products free of charge.

The present guarantee is valid only in case of compliance with the way of care and wearing of the products recommended and brought to the attention of the customer by presenting the present guarantee certificate.

If the product does not meet the requirements, the buyer contacts the store where the product was purchased, later the product is accepted for return and a complaint resolution report is drawn up.

The consumer has the right to ask the seller to take the following measures to eliminate defects: (1) bring the product into compliance; (2) replacement of the product at your choice, if this requirement is impossible or different; (3) price proportionate reduction or (4) refund of the paid price, under the conditions provided by Government Emergency Ordinance No. 140/2021, the seller has the right to choose the method of payment in the case of the price refund.

The consumer exercises the right to terminate the contract through a request addressed to the seller, where he will communicate the decision to terminate the sale-purchase contract. In order to benefit from the terms and conditions stipulated in the Warranty Certificate, the consumer is obliged to keep/present the invoice/receipt and all the accessories received which purchased product.

If a defect of the purchased product is confirmed, the seller may refuse to bring the respective product into conformity in favor of a proportional price reduction or a refund if repair or replacement is impossible or would involve costs that would be different/ higher taking into account all the circumstances.

The consumer does not have the right to request the termination of the contract if quality non-conformities/defects are minor.

If the non-conformity is eliminated by replacing the product, in this case the two-year warranty period provided by law starts from the date of its replacement.

The warranty becomes inapplicable and the seller will not be liable for any defects that may occur due to: (1) cleaning/maintenance procedures that are not in accordance with the specific instructions for each product, provided herein; (2) storing or using the products in conditions of high humidity; (3) color changes due to sun exposure or other strong heat sources; (4) intentional or negligent damages; (5) repairs or modifications made by unauthorized persons; (6) normal wear and tear of the product; (7) improper use, incorrect conditions by consumers other than those for which the product was designed.
